The G20 asked OECD to address this growing problem by creating this action plan to address base erosion and profit shifting. This plan identifies a series of domestic and international actions On 4 December 2017, the OECD released the first annual peer review report, which covered the assessment of 44 jurisdictions (i.e., OECD and G20 countries and countries that were in the OECD accession process during the BEPS project) for the 2016 calendar-year period. Out of 2,295 tax treaties in force between “Inclusive Framework” countries on July 1, 2020, only about 350 treaties were compliant with the minimum standard on tax treaty shopping set out the OECD/G20 base erosion profit shifting (BEPS) plan Action 6 final report, the OECD said. On 12 October 2020, the Organisation for Economic Co-operation and Development (OECD) Secretariat released an economic impact assessment report (the Report) on the international tax changes being developed in the ongoing project on addressing the tax challenges arising from the digitalization of the economy (the BEPS 2.0 project). This work follows on the heels of the OECD/G20 Base Erosion and Profit Shifting (BEPS) project and is in some ways a continuation of that work. The OECD is aiming for a solution that results in the removal of “relevant unilateral measures” including digital services taxes and similar policies and sets a new normal in international tax, although getting to that point will require sufficient political commitment to implementing the OECD’s approach. The OECD model might not be the root of all evil, but it is the seed of discontent. Tax treaties explain why BEPS had to happen. The U.N. model treaty offers a different approach.
